As a public service, and to further its statutory purposes, the Division of Travel & Tourism permits photographic materials, such as photographs and color separations (“Division Photos”), and video footage to be copied or reproduced at the applicant’s expense, provided that you agree to abide by the terms of this permit:
  1. Photo/Video Credit. You agree that the reproduction of the Division Photos/Videos you utilize shall be accompanied by a credit (Example: Photo/Video courtesy of New Jersey Division of Travel & Tourism; VisitNJ.org).
  2. Releases from Third Parties.  You are responsible for obtaining any written releases you may require from recognizable people or the owners of recognizable properties, trademarks, or trade names pictured in the Division Photos/Videos.  The Division makes no representation to you that it has obtained releases from third parties authorizing your use of their likeness.
  3. Restrictions on Commercial Use - Copyrights. You agree that Division Photos/Video segments will not be published, reproduced or distributed for any commercial purpose, such as the advertisement or promotion of a commercial venture, or incorporation into a product offered for sale, unless you obtain express permission from the photographer/videographer/source listed for each Division Photo (which may require reasonable compensation to the photographer/videographer/source for use of copyrighted material).  Whether or not a photographer/videographer or source is listed, your use of any Division Photo/Video for commercial purposes is undertaken entirely at your own risk.
  4. No Division Endorsement. You agree that this permit to use the Division Photos/Videos is not, and shall not be construed as, an endorsement by the Division of any views you express, or product or service you advertise or promote.
  5. Indemnification. You agree to indemnify, defend and hold harmless the New Jersey Division of Travel & Tourism from all claims, liability, damage, expense or loss, including all claims by third parties, arising out of your publication, reproduction or distribution of the Division Photos/Videos.
  6. When you use Division Photos/Videos, please send us a courtesy copy of your usage.
